The state of Texas requires municipalities that impose impact fees to do an update of the land uses, capital improvements plans and impact fees every 5 years. The previous plan was adopted in March 2022. An impact fee study takes several months to complete following the state's prescribed processes. In order to get a plan ready for adoption, no later than March 2027, a study would need to be initiated this year. The state codes do provide a process for a municipality to skip a 5 year update to the land uses, capital improvements and impact fee updates. If the municipality determines that no substantial changes have been made to land uses and/or capital improvements needed since the last study, a decision can be rendered by Council to make no changes to the current plan.

The Town of Fairview entered into a Lease Agreement with TAG Soccer LLC (hereinafter referred to as “TAG”) on January 8, 2025 allowing TAG to operate a soccer complex and soccer leagues on the Town’s 75-acre property located in McKinney. The Lease Agreement commenced on February 1, 2025 and provides for a five (5) year initial term with an option for a single three (3) year extension term. At the October 8, 2025 regular Town Council meeting, the Town Council authorized the town manager to effectuate the transfer, sale and conveyance of a narrow portion of the Town’s 75-acre property on C.R. 317 in McKinney. The subject strip of property, which is frontage to C.R. 317, and a temporary construction easement, are part of the property leased to TAG by the Town. The strip of property is 1.0023 acres and will be used by a private developer to widen C.R. 317 and relocate an existing Milligan Water Supply Corporation water line easement in conflict with the road widening project. The temporary construction easement is 0.2724 acres in size and will expire following the completion of the road widening project. In addition to compensation for the 1.0023 acre strip of property and the temporary construction easement, the buyer is required to construct a barbed wire fence along the new property boundary which is approximately 790 linear feet in length.

Staff received a resident complaint from the Cypress Crossing subdivision regarding frequent obstructions of mailboxes by parked vehicles. Under USPS guidelines, mail delivery is suspended if a carrier cannot safely access a mailbox without exiting their vehicle. This issue is particularly critical for residents who rely on the timely delivery of prescription medications. While Cypress Crossing and the Village of Fairview have limited street parking with parking on most streets only allowed on one side, a balance must be struck between parking availability and essential service delivery.

Mayor Hubbard and Councilmember Connelly requested this item to be placed on the agenda for Council consideration. The Town contracts election services with the Collin County Elections Office to conduct Town elections. In the process of contracting with the County, municipalities and entities with elections (School boards, Utilities districts, etc.) volunteer their facilities to be a voting location for Early Voting or Election Day Voting only. Additionally, other organizations, such as churches, volunteer space to be a voting location. This is done in the February timeframe as municipalities are calling for their elections. Municipalities may cancel their elections after the deadline to file an application for a place on the ballot and may remove their facilities as voting locations. The Early Voting and Election Day Voting locations are not finalized by the County until early March. In 2025, the County approved the transition from electronic voting machines to hand-marked paper ballots, resulting in less space being used and less security needed.

For decades Fairview residents, businesses and local government operations have experienced a wide range of mail delivery and non-mail delivery related problems due to the 75069 ZIP Code shared with McKinney. Fairview’s shared ZIP Code has resulted in mail, package deliveries, and time sensitive communications intended for Fairview addresses being significantly delayed or not delivered at all. The State of Texas Comptroller’s Office has accidentally remitted Town sales tax revenue to McKinney. Other problems and concerns include online sales tax revenue being directed to the wrong jurisdiction, receiving inaccurate home and business insurance rates, and that inaccurate census data may deprive the Town of access to beneficial federal and state grant opportunities. Fairview’s shared ZIP Code created confusion leading up to the March 2026 primary election when a large number of Fairview residents received voter registration cards showing their home address as being located in McKinney. Fairview’s ongoing efforts to have the United States Postal Service (USPS) assign it a single unique ZIP Code and resolve its ZIP Code related problems began in 2010. Fairview has gone through the required USPS ZIP Code Boundary Adjustment request process twice (allowed one request every 10 years), which were denied. Since 2010, the Town has received support from three different U.S. Representatives in order to obtain its own single unique ZIP Code and those efforts did not result in the desired outcome. In the 118th Congress (2023-2024), with the support of U.S. Representative Keith Self, Fairview was included in a bill that would have resulted in Fairview receiving its own unique ZIP Code. The bill passed with bipartisan support in the U.S. House of Representatives. The bill ultimately died in the U.S. Senate due to the Senate failing to act on the bill prior to the end of the 118th Congress. Fairview, with U.S. Representative Keit

The Council appoints citizen volunteers to serve on Town boards and commissions. Appointees remain in their roles until they are either reappointed or replaced. Information about the responsibilities of each board and commission is published in the Fairview Town News magazine and on the Town's website, encouraging residents to apply for these positions. Interested applicants are required to complete an application, specifying the boards or commissions they wish to serve on and providing background information relevant to their application. The Council generally aims to rotate members off committees after six years of service, except in cases where extending their term aligns with a specific business need. This policy has been applied selectively across various boards, based on specific circumstances.
